# Real Estate Marketing in 2026: Older Buyers, Social-First Leads and a Truce in the Zillow-Compass Listing War

*Two years after the NAR settlement, agents must sell their value in writing, first-time buyers have fallen to a record-low 21% and Compass has dropped its suit over Zillow's listing rules. Here is what that means for agencies marketing agents and brokerages, from social leads to uneven AI adoption.*

Two years after the National Association of Realtors' commission settlement took effect, real estate marketing in 2026 is shaped by three forces. Agents have to explain their value more explicitly. The biggest listing portal and the biggest brokerages are fighting over how homes may be marketed before they hit the MLS. And agents are adopting AI tools unevenly while leaning on social media for leads.

For agencies that serve agents, teams and brokerages, the result is a market where positioning, compliance-aware messaging and owned channels count for more than they did.

## The Settlement Put Value on the Page

The practice changes from NAR's settlement took effect August 17, 2024. According to NAR's own explainer, offers of compensation to buyer brokers are no longer allowed on MLS platforms. Sellers may still offer compensation outside the MLS. Agents working with buyers must also enter into written agreements before touring a home.

Those agreements must include a specific and conspicuous disclosure of the amount or rate of compensation. Compensation must be objective, such as a flat fee, percentage or hourly rate, and not open-ended. The agent cannot receive more than the agreed amount, and the agreement must state that broker fees and commissions are fully negotiable and not set by law.

The marketing effect is that buyer agents now have to make their case, in writing, before the first showing. That has made value messaging, from service explanations to fee rationales, a front-line marketing task rather than a closing conversation.

## Agents Still Dominate, but the Customer Has Changed

Consumers have not abandoned agents. NAR's 2025 Profile of Home Buyers and Sellers, summarized on November 3, 2025 by NAR deputy chief economist Jessica Lautz, found that 88% of buyers used a real estate agent or broker. So did 91% of sellers, while for-sale-by-owner transactions fell to a historic low of 5%.

The buyers themselves look different. First-time buyers fell to 21% of the market, the lowest share since NAR began tracking in 1981, and their median age hit a record 40. The median age of repeat buyers climbed to 62. All-cash buyers stayed at an all-time high of 26%. Sellers held their homes for a median of 11 years before selling, also a record. Only 24% of buyers had children under 18 at home, down from a high of 58% in 1985.

These numbers matter for targeting and creative. Campaigns built around young first-time families describe a shrinking slice of actual transactions. Older, equity-rich repeat buyers and long-tenured sellers are a larger share of the business.

## The Listing Wars Reached a Truce, for Now

The fight over where and when listings appear has been the most visible marketing story of the past year. Zillow announced its Listing Access Standards in April 2025. According to NAR's reporting, they require publicly marketed residential listings to appear on an MLS within one day of initial marketing to be displayed on Zillow. Compass, which favors letting sellers market homes privately before they go to the MLS, sued Zillow over the policy.

On February 6, 2026, a New York federal judge denied Compass's request for a preliminary injunction. "Even assuming that Zillow possesses a 50%–66% share of the relevant market, Compass has not provided sufficient evidence from which it can be inferred that Zillow has monopoly power in the online home search market," the judge wrote, as quoted by NAR.

On March 18, Compass CEO Robert Reffkin said the company would dismiss its lawsuit. He pointed to Zillow's introduction of Preview, a product that highlights pre-market listings, which he characterized as a reversal. "Because of this reversal, we are dismissing our lawsuit against Zillow," Reffkin said, according to Real Estate News. GeekWire reported that the dismissal was without prejudice and that Zillow said its Listing Access Standards "remain in effect" and that it "will continue to choose not to display listings that were previously hidden from the public." A Zillow spokesperson added: "Private listing networks are not in the best interests of consumers, and they never have been."

NAR has its own framework in the background. It kept its Clear Cooperation Policy, which took effect in May 2020, and in March 2025 introduced Multiple Listing Options for Sellers, which lets MLSs set delayed marketing periods, according to NAR.

For listing marketers, the practical rule is still a patchwork. Pre-marketing is possible, but where a listing is shown first can affect whether the largest portal displays it later.

## Social Leads, Uneven AI

Agents' own reports suggest social media is the most productive lead channel. In NAR's 2025 Technology Survey, fielded in July 2025 with 1,241 usable responses, 39% of Realtors said social media produced their highest-quality leads. That compared with 23% for CRM, 17% for the local MLS, 13% for brokerage websites, 12% each for digital ad campaigns and personal websites, and 9% for listing portals, as reported by HousingWire.

AI adoption is real but split. NAR found 20% of agents use AI daily and 22% weekly, while 32% had not used it in their business. ChatGPT was the most-used tool (58%), followed by Gemini (20%) and Copilot (15%). Asked about impact, 17% reported a significantly positive effect and 33% a moderately positive one, while 46% saw no noticeable difference. "Technology continues to be a powerful force in real estate, driving efficiency and marketing innovation. But at the heart of it all remains the trusted relationship between the agent and client," Lautz said.

## What This Means for Your Business

- **Make the value case marketable.** Help agent and brokerage clients turn their service model into clear, compliant content (what the buyer gets, how fees work, what is negotiable) that supports the written-agreement conversation. Have brokerage compliance review fee language.
- **Retarget the creative.** With first-time buyers at 21% and a median age of 40, audience strategies and imagery should reflect older repeat buyers, cash buyers and long-tenured sellers as well as first-timers.
- **Plan listing launches around portal rules.** Before recommending pre-marketing, private or "coming soon" strategies, confirm the client's MLS rules and how Zillow's standards and Preview treat the listing.
- **Invest in social and video, with measurement.** Agents rank social as their top source of quality leads; agencies can add consistent posting, short-form video and lead tracking so that claim can be tested.
- **Offer AI enablement, not just AI content.** With a third of agents not using AI and nearly half seeing no impact yet, training and workflows for listing copy, follow-up and CRM use may be a more valuable service than more generated posts.
